In accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “GDPR”, and Polish law, including, inter alia, the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000), we hereby provide information on the processing of your personal data by SP-CORPORATE Legal Szermach Kancelaria Adwokacka Maciej Szermach (e.g., in connection with the provision of legal advice or the use of the website https://www.legalszermach.com/, hereinafter also referred to as the “Website”) and information on cookies.

 

Who will be the controller of your data?

For what purpose and on what legal basis will we process your data?

The purposes and legal bases for processing your personal data depend on the nature and reasons for which the Law Firm processes your personal data.

  1. If you use the Law Firm’s website, your personal data will be processed to enable you to use the Website. This allows us to inform you about the profile, activities, and achievements of the Law Firm, which constitutes a legitimate interest of the data controller and is the legal basis for processing your personal data (Article 6(1)(f) of the GDPR). In this case, the legitimate interest of the Law Firm, for which your personal data may be processed, also includes the need to ensure the security associated with the functioning of the Website.

Having your personal data by the Law Firm is not a legal or contractual requirement, however, it is necessary for you to fully and correctly use the Website. The processed data enable visitors to retrieve information from the Website’s servers, ensure the proper functioning of the Website, and also the security of the Law Firm’s data.

  1. If the Law Firm obtains your personal data in connection with the provision of legal assistance (e.g., on your behalf, on behalf of companies/firms you are employed by, or on behalf of participants in cases in which you are involved), then your data will be processed to provide legal assistance, depending on the matter for which the Law Firm has been engaged (such as representation in court, preparation of contracts or legal opinions, etc.).

In this case, your personal data are processed on the following legal bases:

  1. a) Article 6(1)(b) of the GDPR, which provides that the processing of personal data is lawful if it is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract – such a contract is entrusted to us by you or another person for the provision of legal assistance;
  2. b) Article 9(2)(f) of the GDPR, which provides that the processing of personal data is lawful if it is necessary for the establishment, exercise or defense of legal claims;
  3. c) Article 6(1)(c) and Article 9(2)(g) of the GDPR, which provide that the processing of personal data is lawful where such processing is necessary for compliance with a legal obligation to which the controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller – in such circumstances, the provision of legal assistance by persons exercising a profession of public trust, such as a lawyer or legal advisor, is undoubtedly a public interest task.

In such a situation, having your personal data by the Law Firm will generally be a contractual or legal requirement, and without your personal data, the provision of legal services by the Law Firm may be impossible.

  1. If the Law Firm obtains your personal data in connection with a concluded or potential contract (e.g., for employment or civil law), then the performance or conclusion of that contract is the purpose of processing your personal data.

In this case, the legal basis for processing your personal data will be Article 6(1)(b) of the GDPR, which provides that processing is lawful if it is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract. The legal basis for the processing of your personal data will also be the fulfillment of legal obligations incumbent on the Law Firm as the controller of your data (Article 6(1)(c) of the GDPR), e.g., in connection with the need to make tax settlements, ZUS, etc.

In such a situation, having your personal data by the Law Firm will generally be a contractual or legal requirement, and without your personal data, the conclusion or performance of the contract may be impossible.

 

Depending on the situation, the legal basis for the processing of your data may also be your consent (Article 6(1)(a) of the GDPR, Article 9(2)(b) of the GDPR). In such a case, withdrawal of your consent is free of charge and possible at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

 

Your data will not be processed in an automated manner, including profiling.

 

How long will we keep your data?

Personal data will be processed for the duration of the activities described above, and unfortunately, it is not possible to provide a specific period for processing your data. If this matter raises doubts for you, we kindly ask you to contact the Law Firm directly.

At the same time, however, we assure you that your personal data will not be processed for longer than required or permitted by applicable law.

 

To whom may we share your data?

In accordance with applicable law, we may disclose your data to entities processing them on our behalf or other data recipients, especially IT companies collaborating with the Law Firm.

Your personal data will not be transferred to third countries within the meaning of the GDPR. However, if necessary or justified, the transfer of your data to a third country will be carried out in accordance with applicable legal regulations.
